Lei Sargento PM Dias: Uma Nova Abordagem na Execução Penal com Veto em Discussão

Aprovada em 11 de abril de 2024, a Lei nº 14.843, conhecida como Lei Sargento PM Dias, representa um marco significativo na legislação penal brasileira. Com o intuito de aprimorar o sistema de execução penal, a lei traz importantes alterações à Lei de Execução Penal (Lei nº 7.210/1984), abordando questões cruciais como monitoração eletrônica do preso, realização de exame criminológico para progressão de regime e restrição do benefício da saída temporária.
Uma das principais mudanças introduzidas pela Lei Sargento PM Dias diz respeito à monitoração eletrônica do preso. Agora, o equipamento de monitoração eletrônica pode ser utilizado pelo condenado em diversas situações previstas em lei, proporcionando maior controle e acompanhamento das atividades do apenado fora do estabelecimento prisional.
Além disso, a lei estabelece a realização obrigatória de exame criminológico para a progressão de regime, garantindo que apenas os apenados que demonstrem boa conduta carcerária e baixa periculosidade possam avançar para regimes mais brandos.
Outra importante alteração é a restrição do benefício da saída temporária para condenados por crimes hediondos ou praticados com violência ou grave ameaça contra a pessoa. Essa medida visa proteger a sociedade e evitar que criminosos perigosos retornem às ruas sem o devido acompanhamento e controle.
No entanto, parte da lei sofreu veto presidencial e está em análise pelo Congresso Nacional. Resta agora acompanhar de perto a discussão e possíveis alterações decorrentes desse processo, visando uma execução penal mais eficiente e segura no Brasil.
